Terms of Service & Medical Disclaimer
Terms of Service:
This Service Agreement (the “Agreement”) is entered into on the date of purchase (the “Effective Date”) with Emerge with Amy LePage (the “Service Provider”) located in Montpelier, VT and the “Client” also individually referred to as the “Party”, and collectively as the “Parties”.
1. Services. The Service Provider shall perform the services listed in this Section 1 (the “Services”).
1Provides self-paced, streaming video courses
OR
2 Provides group movement classes, workshop, series or individual movement classes.
OR
3 Provides somatic bodywork
OR
4 Provides childbirth education classes - privately and in a group setting
2. Payment. The Client agrees to pay the Service Provider current prices listed on www.emergewithamylepage.com and the linked in Noterro scheduler platform as payment for the Services provided - either before or at the time of service. Payment will be made in US dollars.
3. Expenses. The Client will not be liable to reimburse the Service Provider for any expense(s).
4. Term. The term of this Agreement shall commence on the Effective Date per the terms of this Agreement.
5. Termination / Refunds.
See the Refund Policy to learn more about refunds for streaming, on-demand video content and classes and individual sessions.
Class cards are not refundable even if the Client does not use all the classes.
Class Series payments are not refundable after the series has started even if Client does not attend the entire series.
Individual session payments are due at the time of service and are not refundable.
Childbirth education group & private session payments are not refundable after Client has participated in a portion or all of the class.
6. In the event the Service Provider terminates the Agreement, by no longer having on-demand courses on the website - Client will receive an option for how to download the purchased video content to continue to have access to it.
7. Dispute Resolution.
Choice of Law. The Parties agree that this Agreement shall be governed by the State of Vermont, USA.
Negotiation. In the event of a dispute, the Parties agree to work towards a resolution through good faith negotiation.
8. Attorney’s Fees. In the event that a dispute cannot be resolved through good faith negotiation, neither Party will be responsible for payment of the other Party's legal fees, including, but not limited to, attorneys’ fees of the prevailing Party.
9. General.
Assignment. The Parties may not assign their rights and/or obligations under this Agreement.
Complete Contract. This Agreement constitutes the Parties entire understanding of their rights and obligations. This Agreement supersedes any other written or verbal communications between the Parties. Any subsequent changes to this Agreement must be made in writing and signed by both Parties.
Severability. If any section of this Agreement is found to be invalid, illegal, or unenforceable, the rest of this Agreement will still be enforceable.
Waiver. Neither Party can waive any provision of this Agreement, or any rights or obligations under this Agreement, unless agreed to in writing. If any provision, right, or obligation is waived, it is only waived to the extent agreed to in writing.
The Parties agree to the terms and conditions set forth above at time of purchase.
